Comments Regarding The NextG Proposal
Many residents have expressed concern about the wireless transmission facilities proposed by NextG for installation in residential areas and have questioned why the Board of Trustees is even considering the matter. What must be understood is that the Village did not seek out this proposal, and it is not an initiative on our part to achieve any commercial gain.
NextG is the local affiliate of a nationwide company that provides infrastructure support for wireless communication networks. In this capacity, it claims to operate with certain legal rights stemming from a public policy supporting a vigorous national communication capability. NextG has a Certificate of Public Convenience and Necessity from the New York State Public Service Commission under which it claims the authority to utilize the public rights of way within the Village for its installations; it also makes claim to similar empowerment under the Federal Telecommunications Act.
The Mayor and the Board of Trustees, along with Village Counsel, are making diligent inquiry to determine if, in fact, NextG has the authority that it claims and, if so, what reasonable limitations or requirements the Village may impose on any installations that are proposed. No action will be taken by the Village before these questions are answered to our legal and operational satisfaction. Residents will be apprised in advance of any further action by the Board of Trustees.
